Arcadian Gossip is operated by Stephen Andrew Weller (hereafter "Arcadian Gossip") and hosted on the Substack platform (the "technology provider" or "Substack"). By using this website, reading its blog, accessing the newsletter you subscribed to, or engaging with any associated services from Arcadian Gossip, you agree to these Terms of Use. If you do not agree, please discontinue use of Arcadian Gossip immediately.

1. Agreement

By accessing Arcadian Gossip, you acknowledge and accept these Terms of Use, constituting a legally binding agreement between you and Arcadian Gossip. No other terms, verbal or written, shall apply.

2. Third-Party Terms

These Terms do not replace Substack’s Terms of Service, which apply separately to your use of the platform. Arcadian Gossip may contain links to third-party services or content, but does not endorse or assume responsibility for them. Users should review and accept third-party terms independently.

3. Nature of Content & Intellectual Property Rights

Arcadian Gossip is a blog featuring original poetry, opinion pieces, and miscellaneous creative works. The content may include:

• Poetry (original compositions, reflections, and experimental writing).

• Opinion pieces (personal essays, cultural commentary, and critiques).

• Miscellaneous content (creative explorations, informal musings, and literary expressions).

Intellectual Property Protection:

• All original content, including poems, essays, and creative works, is the exclusive property of Stephen Andrew Weller. Unauthorized reproduction, distribution, or adaptation of this content is strictly prohibited.

• Any attempt to translate, adapt, or republish Arcadian Gossip content in other languages without prior authorization is prohibited.

• Quotations of brief excerpts for review or academic purposes must include clear attribution to Arcadian Gossip.

5. Refunds & Chargeback Policy

All sales are final. No refunds, exchanges, or credits will be provided for:

• Subscriptions to Arcadian Gossip, including newsletter access and digital content.

• One-time digital purchases or downloadable content.

• Any other services offered by Arcadian Gossip, except where required by applicable law.

Chargebacks are prohibited, and any disputes may result in account termination or legal action.

6. Disclaimer of Liability & Liability Cap

To the fullest extent permitted by law, Arcadian Gossip disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from the use of its content. Content is provided "as is" without warranties of accuracy, completeness, or suitability for a particular purpose.

If liability is found, it shall not exceed the total fees paid by the claimant in the three (3) months preceding the claim.

7. User Conduct & Moderation

Users must engage respectfully. Harassment, hate speech, or disruptive behavior is not tolerated. Arcadian Gossip reserves the right to remove content or restrict access at its sole discretion.

8. Governing Law & Jurisdiction

These Terms are governed by German law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Freiburg, Germany. However, where applicable, U.S. law may also apply to certain matters concerning Stephen Andrew Weller’s status as a U.S. citizen.

9. Modification of Terms

Arcadian Gossip reserves the right to modify these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
